Welcome to Nuua Beach. These terms and conditions govern your use of our website and services. By accessing our website or making a reservation, you agree to be bound by these terms.

1. General Terms of Website Use
1.1 Acceptance of Terms
By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. These terms apply to all visitors, users, and others who access or use our website.
1.2 Use License
Permission is granted to temporarily access the materials on Nuua Beach's website for personal, non-commercial transitory viewing only. This license shall automatically terminate if you violate any of these restrictions.
1.3 Prohibited Uses
You may not use our website:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
2. Reservation Terms
2.1 Booking System
All reservations are made through our UMAI booking system. By making a reservation, you agree to UMAI's terms of service in addition to these terms.
2.2 Reservation Confirmation
All reservations are subject to availability and confirmation. We reserve the right to refuse service to anyone for any lawful reason. A reservation is only confirmed when you receive a confirmation email.
Important: We operate a cashless payment policy. Credit/debit cards and mobile payments are accepted. Cash is not accepted for any purchases.
2.3 Table Reservations
- Table reservations are held for 15 minutes past the reserved time
- After 15 minutes, the table may be released to waiting guests
- We may contact you if you are running late
- Table reservations are for dining; minimum spend requirements may apply during peak periods
2.4 Sunbed Bookings
- Sunbed reservations are for all-day use (10:00 AM - 7:00 PM)
- Sunbeds cannot be transferred to other parties
- Personal belongings are left at your own risk
- Sunbed areas are non-smoking zones
2.5 Workspace Bookings
- Workspace reservations are available until 12:00 PM daily
- Wi-Fi and basic amenities are provided
- Laptops and work materials must be removed by designated time
- Quiet work environment policies apply
3. Cancellation and No-Show Policy
3.1 Cancellation Policy
- Table reservations: Can be cancelled up to 2 hours before reservation time
- Sunbed bookings: Can be cancelled up to 24 hours before the booking date
- Group bookings (8+ people): Require 48 hours advance notice for cancellation
- Special events: Cancellation terms will be specified at time of booking
3.2 No-Show Policy
In the event of a no-show:
- Your reservation will be cancelled after the grace period
- For future bookings, we may require advance payment or deposit
- Repeated no-shows may result in booking restrictions
3.3 Weather Policy
Due to our beachfront location, reservations may be subject to weather conditions. In case of severe weather, we will contact you regarding possible rescheduling or cancellation options.
4. Payment Terms
Cashless Policy: Nuua Beach operates a completely cashless payment system.
Accepted payments: Credit cards, debit cards, contactless payments, mobile wallets
Not accepted: Cash, cheques, cryptocurrency
4.1 Payment Processing
- All payments are processed securely through our payment partners
- Prices include applicable Portuguese taxes (IVA)
- Card authorization may be required for certain bookings
- Foreign transaction fees may apply depending on your bank
4.2 Deposits and Prepayments
We may require deposits for:
- Large group bookings (8+ people)
- Special events and private functions
- Peak season or holiday bookings
- Guests with previous no-show history
5. Conduct and House Rules
5.1 Guest Conduct
All guests are expected to:
- Treat staff and other guests with respect and courtesy
- Follow all posted signs and staff instructions
- Dress appropriately (beachwear is welcome, but shirts/cover-ups required in dining areas)
- Keep noise levels considerate of other guests
- Supervise children at all times
5.2 Beach and Safety Rules
- Swimming is at your own risk; no lifeguard on duty
- Follow all beach safety guidelines and warning flags
- Smoking is only permitted in designated outdoor areas
- Pets are welcome but must be on leash and well-behaved
- Glass containers are not permitted on the beach area
5.3 Right to Refuse Service
We reserve the right to refuse service or ask guests to leave for:
- Disruptive, offensive, or inappropriate behavior
- Violation of our house rules or policies
- Intoxication or substance abuse
- Safety concerns
6. Intellectual Property
6.1 Content Ownership
All content on this website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of FLAMINGO ALEGRE - UNIPESSOAL LDA and is protected by Portuguese and international copyright laws.
6.2 Photography and Social Media
By visiting Nuua Beach, you consent to being photographed or filmed for promotional purposes. If you prefer not to be included in any marketing materials, please inform our staff.
6.3 User-Generated Content
By posting photos or content and tagging @nuua_beach or using our hashtags, you grant us permission to use your content for promotional purposes on our social media channels and website.
7. Liability and Disclaimers
7.1 Limitation of Liability
FLAMINGO ALEGRE - UNIPESSOAL LDA shall not be liable for:
- Personal injury or property damage not caused by our negligence
- Loss or theft of personal belongings
- Weather-related cancellations or disruptions
- Third-party services (surf lessons, transportation, etc.)
- Indirect, incidental, or consequential damages
7.2 Force Majeure
We are not liable for any failure to perform due to unforeseen circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, or public health emergencies.
7.3 Health and Safety
Guests participate in beach and water activities at their own risk. We recommend:
- Following all posted safety guidelines
- Swimming only in designated areas
- Using appropriate sun protection
- Informing staff of any medical conditions or allergies
8. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
9. Governing Law and Jurisdiction
9.1 Applicable Law
These terms and conditions are governed by and construed in accordance with the laws of Portugal. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Lisboa, Portugal.
9.2 Consumer Rights
Nothing in these terms affects your statutory rights as a consumer under Portuguese or EU law.
10. Changes to Terms
We reserve the right to update these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
